Enforcement against ULEZ evaders stepped up by TfL

Enforcement measures are being significantly ramped up by TfL as the organisation targets drivers who repeatedly evade penalty charge notices (PCNs) for violations of the Ultra Low Emission Zone (ULEZ). This crackdown comes in response to a growing cohort of individuals who refuse to pay their fines, resulting in substantial outstanding debt that could otherwise be reinvested into London’s transport network.

To enhance its enforcement capabilities, TfL is tripling the size of its investigations team. This boost will work in conjunction with enforcement agents to focus on drivers of polluting vehicles who disregard the daily charges. TfL is employing a more intelligence-led approach, which includes enabling bailiffs to visit evaders’ homes, clamp or seize vehicles, and auction them off to recover debts. Failure to pay fines within the statutory timeframe incurs additional fees, compounding the financial burden on offenders.

The ULEZ, expanded citywide on 29th August, 2023, addresses air pollution, climate change, and traffic congestion in London. Each year, approximately 4,000 premature deaths are linked to poor air quality, disproportionately impacting vulnerable communities. The revenue generated from ULEZ fines is intended for reinvestment in public transport improvements, not profit-making.

Recent data indicates that over 96% of vehicles in the ULEZ comply with emission standards, meaning the majority of drivers do not incur daily charges. TfL’s camera system monitors vehicle compliance, sending PCNs to those who fail to pay. If penalties remain unpaid, they become registered debts, leading to court-issued warrants and subsequent enforcement actions.

Notable cases illustrate the effectiveness of these enforcement strategies. In one instance, a driver with 45 outstanding warrants was located, eventually settling nearly £16,000 in fines. Another driver, facing 21 warrants, was repeatedly visited by enforcement agents before paying off over £7,800.

Bailiffs are empowered to seize assets to settle debts, and between August 2023 and July 2024, 1,429 cars were confiscated. Of these, 761 were auctioned, recovering £710,147 from those who refuse to comply with the ULEZ charge.

TfL urges those who receive ULEZ penalties to engage with the notices, offering assistance and payment plans to make the process more manageable for offenders.
