UK sandeel fishing ban upheld despite EU challenge

A long-running row over fishing rights in the North Sea has taken a decisive turn after an international court upheld the UK’s decision to restrict trawling for UK sandeels – small, silvery fish that form a key link in the marine food chain. The ruling comes after months of legal wrangling sparked by objections from European commercial fishing bodies, particularly in Denmark, where sandeel catches support a sizeable share of the industry.

The ban, which came into effect across English and Scottish waters in early 2024, was designed to prevent further depletion of sandeel stocks in an effort to protect seabirds and wider marine ecosystems. Puffins, kittiwakes and other coastal birds are heavily reliant on these fish for food, particularly during the breeding season. With numbers of some species under pressure, the move was seen by many in conservation as long overdue.

The challenge to the ban centred on claims that it unfairly restricted access to EU fishing vessels and was not justified by the available data. However, the court dismissed most of the arguments, concluding that environmental measures could be upheld so long as they were rooted in scientific evidence. The UK is required to make some adjustments to the way it implemented the English part of the closure but has not been ordered to reverse the decision itself.

Officials say the ban was put in place using the best data available and remains an important part of efforts to restore balance to the North Sea’s ecosystem through sustainable fisheries management. UK Sandeels might not be widely known beyond coastal communities, but they underpin the diets of many larger species and play a quiet yet crucial role in the health of surrounding waters.

In some quarters, the ruling has been welcomed as a reaffirmation of post-Brexit powers to manage UK waters according to domestic environmental priorities. In others, it’s viewed as a challenge to maintain relationships with neighbouring fishing nations while still putting long-term ecological interests first.

Meanwhile, the debate continues over the broader direction of sustainable fishing in northern European waters. The sandeel fishing ban now stays in place, including in Scottish areas where it had strong political backing. The UK’s next step is to comply with technical aspects of the ruling, but the wider ban remains intact.

For those working in coastal conservation and environmental policy, the decision has added weight to calls for further marine protections – not just in headline-grabbing areas but in overlooked habitats and species that are part of everyday life along the British coast.
